Who Is Eligible for the EB3 Visa?
If the job offered falls under one of the following categories, the EB3 visa may be the ideal option for you to pursue residency in the U.S:
- “Skilled workers” are persons whose jobs require a minimum of 2 years training or experience, not of a temporary or seasonal nature. The skilled worker must meet the educational, training, or experience requirements of the job opportunity. Relevant post-secondary education may be considered as training.
- “Professionals” are persons whose job requires at least a U.S. baccalaureate or foreign equivalent degree and are a member of the professions.
- The “other workers” subcategory is for persons performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.
How to Apply for the EB3 Visa
To apply for a green card under the EB3 employment-based category, you must have a job offer from a U.S. employer. The employer must first obtain a labor certification from the U.S. Department of Labor. Upon obtaining a labor certification, the employer must file a petition for an immigrant visa with USCIS.
If you are already in the U.S., you may be able to file an adjustment of status application concurrently with the EB3 petition, or you may have to wait for some time after approval of the petition, depending on visa availability for your country of birth.
