Job Changes and Pending Green Card Applications
Executive Immigration Insights

With the October Visa Bulletin bringing movement, many applicants are asking what happens if a job change occurs while an I-485 is still pending.

A pending I-485 is tied to the I-140 filed by the sponsoring employer. Many applicants do not realize that USCIS must still confirm that a valid job offer exists before approving the case. This is where portability rules come in.

Under these rules, applicants may be able to continue their green card process after changing jobs, provided the case has been pending long enough and the new role is in the same or a similar occupational category.
USCIS confirms this through Form I-485 Supplement J.

A Supplement J can be filed proactively or when USCIS requests it before making a decision. The key point is that a job change does not automatically end the process, but it does raise questions that USCIS will address before approval.

With increased filing activity this October, understanding these rules can help applicants avoid surprises and keep their cases on track.

Every case is different, and immigration agencies review applications based on individual facts. If you would like tailored guidance on your situation, we invite you to schedule a consultation with our office.
